Cancellation Policy
- No Refusal to Pay:
You cannot refuse to pay maintenance charges, as they are essential for the upkeep of common areas and amenities.
- Complaints and Disputes:
If you believe you are being overcharged or if there are issues with how the maintenance funds are being used, you can file a complaint.
- RERA and Builders:
If the dispute is with the builder before the handover to the Residents' Welfare Association (RWA), you can file a complaint under RERA.
- RWA and Societies:
After handover, the RWA or society manages maintenance charges. They must be reasonable, transparent, and mutually agreed upon.
- Refunds and Resolutions:
Possible outcomes of complaints include refunds of excess charges, penalties on the builder, or directions for fund transfer to the RWA with an audit.
- Penalty for Non-Payment:
Societies may impose interest or penalties on late payments.
- Types of Maintenance Charges:
Maintenance charges can be based on factors like per square foot, equal distribution, or a hybrid model.
- Developer Responsibility:
The developer is typically responsible for maintenance charges of unsold units until they are handed over to the society.
